Agreement of the Terms

This website is operated by BelleNest. By accessing this website you agree to the terms and conditions mentioned below. These terms and conditions constitute a legally binding agreement between you, whether personally, or on behalf of an entity (“you”) and “BelleNest” concerning your access to the website and by placing an order with us via our website, phone, or over any form of social media account operated by BelleNest you agree to the terms and conditions hereby mentioned.

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

We reserve the rights to update, modify, reverse these terms at any time and for any reason. And It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on this site is intended to be used to review, consider, purchase, and otherwise engage in retail transactions with BelleNest. The information provided must not be used for distribution in jurisidiction where such distribution would be considered to be contrary to the law or would require registration as per the jurisdiction or the country.

The site is intended to be used by persons 18 years of age or older and must not be used by persons under the age of 18.

Intelluctual Property Rights

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Belle NEST. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website

Payment

Following forms of payment are accepted: Credit Card, Debit Card, Netbanking, UPI and third-party wallets. It is within our sole discretion to change and update our prices at any times. Transactions will be conducted in INR.  Payment would be collected at the time of the order and full payment must be made before the orders are dispatched. You agree to provide full, current and accurate account information necessary to complete the order.

Delivery

Delivery will be deemed to have taken place the moment BelleNest has placed the order in the possession of any carrier service of its choosing for customer delivery. BelleNest would not be held personally liable/responsible for lost, stolen or damaged goods once an order has left our possession. Once your order is in the hands of the carrier, we have no control over the delivery process We reserve the right to make deliveries in instalments which shall not relieve you from your obligation to accept and pay for remaining deliveries.

Refund and Return Policy

It is required that in cases of returns and cancellations a mail is to be sent to us at help.bellenest@gmail.com which would be reverted back in 24 hours.

Returns by customer

A return request would be accepted only in cases of damaged product, wrong product received by the customer. In such cases, after the return request has been made the customer must be responsible for shipping the said product back.

Refund will be initiated once the said product has been received by BelleNest as per the address provided by us.

Failure to contact BelleNest timely to arrange a return request may lead to rejection of the return request.

The customer agrees not to dispute the decision made by BelleNest and accept BelleNest’s decision regarding the return validation that is - if the product is valid to be accepted as return or not. Non-Valid return will be sent back to the customer and the customer will be blacklisted for future purchases.

Items to be returned must be unused, unwashed and undamaged. Return items will only be accepted in their original packaging. Any items that have been damaged, soiled or altered will not be accepted and will be sent back to the customer

Custom made products would not be eligible for return request.

Once an order has been placed, BelleNest will not entertain any cancellation requests. We however reserve the right to cancel any order as per our sole discretion and upon such cancellation the refund shall be processed in 10 business days. Such cancellations may be made due to difficulty in fulfilling any orders. We may also require additional verification or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.

The customer agrees not to dispute the decision made by BelleNest & accept BelleNest decision regarding the cancellation

Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) [your Contributions]; (2) use of the Site; (3) breach of these Terms of Use; (4) any breach of your representations and warranties set forth in these Terms of Use; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the Site with whom you connected via the Site.

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

Limited Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.

Compliance with Laws

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the domestic laws of India.

Jurisdiction of Disputes

All disputes concerning BelleNest would be subject to the exclusive jurisdiction of the courts in Agra, Uttar Pradesh
